A PERM Labor Certification is one of the ways that allows an employer to hire a foreign worker to work permanently in the United States. The US Department of Labor (DOL) processes applications for PERM Labor Certification. In most cases, before the US employer can submit an immigration petition to the US Citizenship and Immigration Services (USCIS), the employer must obtain an approved labor certification request(Form ETA 9089) from the DOL.
The DOL must certify to the USCIS that there are no qualified US workers available and willing to accept the job at the prevailing wage for that occupation in the area of intended employment. The date the PERM labor certification application is filed with the DOL is known as the priority date.
